Exposé of AAP's Modi exposé: Private-Public Partnership

Modi has allotted 14306 acres (roughly 5.67 crore sq meters) of land to Adanis in Kutch area itself. This land has been transferred to them at rates ranging from Re 1 per sq meter to Rs 32 per sq meter for SEZ. In fact, most of the land has been allotted at less than Rs 10 per sq meter. Most of the land is allotted in Mundhra village, where the market rate is Rs 200 to Rs 315 per sq meter for industrial use and Rs 1000 to Rs 1575 per sq meter for commercial use. If we take Rs 10 per sq meter as the average price at which land has been given to Adanis and if we take Rs 300 per sq meter as the average market price, it means that Modi has given an illegal benefit to Adanis to the tune of Rs 1600 crores.

Setting the context

We have paid highway toll one time or the other during our road trips. Why do we pay highway toll? If we did not pay toll, would our lives be easier? Are companies collecting toll are "sucking blood" out of us with such high toll rates?

Do we pay highway toll because roads and land of highway are owned by companies collecting toll?
Answer: We pay toll tax because companies that are collecting it have built roads on land given by the govt. So the company doesn't really own the land, but they charge us for their investment + profit from investment.

Such agreement is called BOT - Build Operate Transfer.

After the end of agreement period, toll collection is stopped or handed over to the govt, and company collecting toll goes completely out of picture. Most of our highway tolls operate on BOT model.

There is another agreement called BOOT - Build Own Operate Transfer. We'll get to that below.

Both BOT & BOOT are tried & tested methods of private-public partnership.

Part - 2: AAP hides Gujarat Govt's BOOT policy right under its sleeve

There is a policy called BOOT that is followed by Gujarat Maritime Board. BOOT stands for Build, Own, Operate, Transfer. Detailed documentation on BOOT policy is available here. For those who don't have patience to read the document (it is very small, all of you should read it), I have summarized key points here:

  1. Gujarat govt will give land to private industry at a price.
  2. Allottee will build infrastructure on the land, own & operate it for a certain period.
  3. Allottee will transfer the whole land+infrastructure back to the govt at the end of period of BOOT agreement.
  4. In the period that private industry owns & operates the land, govt. gets a certain lease revenue from it.
  5. All through the period of lease, govt remains the owner & conservator of the waterfront, and licensor to the developer.
  6. Govt becomes owner of the leased land after the lease agreement is over, and along with it govt also gets the infrastructure.
In a nutshell, BOOT policy encourages private-public partnership where private player earns profit for a limited period of time for investment and govt benefits by getting back a fully operational port with complete infrastructure with little investment. In the process, govt uses desert land as collateral, earning lease rental at the same time.

Here are some of the excerpts from BOOT policy document:

What sleight of hand did magicians in AAP use?

As I said in my earlier post, AAP uses deception to pull out allegations from thin air, akin to magicians pulling out rabbits & pigeons. Following key details were completely hidden from public to make AAP allegations look totally 'fool proof':

  1. There is a policy of BOOT which exists to check crony capitalism & makes govt and its people owners of land & infrastructure. AAP made sure it was never mentioned anywhere in their documentation.
  2. Land was allotted to Adanis, not sold. Notice the detail in their document - they never talk about selling, they only talk about allocation.
  3. Land was allotted in Mundra village, where currently only Gujarat Adani Port Ltd. operates under BOOT.
  4. Govt earns rental from land allotted to Adanis at Mundra.
  5. At the end of BOOT period, land and infrastructure would go back to govt - that is, the people.
  6. Govt gave no illegal benefits to Adani group. Everything was done according to the BOOT law.

To summarize, AAP concluded that Gujarat govt gave land to Adani at throwaway prices where Adani group is operating a port and keeping all profit for itself, with govt having got nothing from the deal. Whereas the reality was that Adani group was only a developer who would get returns for their investment for a limited period through BOOT policy. People are still the owners of the port & its infrastructure as it has not been sold to Adanis.


Masters in Manufacturing of Allegations

AAP holds mastery in manufacturing of allegations against its political opponents. Since the party is relatively new and has a few random faces from IITs, people assume that they are a group of truth-speaking patriots. Even BJP and Congress, who are supposed to be good in politics are not as good at manufacture of allegations against their opponents.

Either AAP doesn't understand public-private partnership, or they are against any private sector business, much like communists and far-left intellectuals. Nothing else would explain their selective hiding of key details about Mundra port deal.

AAP is doing a great job of misleading public in this country with false allegations, false promises & fear-mongering by demonizing everyone other than themselves, and putting everybody else not agreeable to them under the same bucket - "corrupt".

Why does AAP have to resort to lies to prove that it represents people? Would any patriotic organization spread anarchy through fear-mongering about some of the performing governments in the world? When they do, are they patriotic or working on an agenda on someone's behest?

    1. How are you so sure about AAP's cleanliness? Just now, Bhushan has been accused of buying 15 acre land in Himachal Pradesh, illegally.
      There was a sting operation around Shazia Ilmi and Kamar 22 (Kumar Vishwas) as well. And, what about Somnath Bharti's porn domain business?

      AAP is no Gangotri, they are foot soldiers of Congress and Marxists and Maoists. They are there to fool educated people like you and me who are fed up of corruption.

  3. People who are supporting kejriwal are either getting benefited being part of the group (monetarily, positionally) or they are naive enough and are getting mind-washed. We can bring back the naive people who do not know the truth but for others AAP will always be the priority. Similarly there are millions of congress supporters too (because they have some sort of affiliation and get benefits). A well informed citizens of India knows that Kejriwal's party is created just to split anti-congress votes.. and that is why the paid media is giving full coverage to it. Because of the expose of AAP, congress knows it kejri card is not going to work, so they are planning for Lok Sabha elections in Oct - Nov, so that the defeat in states like Rajasthan, MP, Delhi, Chhatissgarh do not bring its image down further before lok sabha elections.

    Can you please provide info on how much land is allotted to adanis under BOOT law, for how much time, at what lease amount and where? is it all of 14306 acres (roughly 5.67 crore sq meters)? I think you are doing what you accuse AAP of, hiding information.

    1. I don't have the information since I haven't filed RTI to get the information about specifics of land pricing.

      What matters here is that AAP concealed the fact that land was never *sold*, it was *leased* and land would *come back* to Gujarat govt after lease expiry.

      AAP said that land was given away at throwaway prices - means sold.

      Again, don't approach me assuming to be a defense lawyer for Modi govt. I'm not.

    You are yet to clarify, are we talking about the same land here? I mean Adanis have been bestowed many many lands. Is this Mundra BOOT project land leased to Adanies the same as and 14306 acres AAP claims had been given away or different? The period and amount of lease, if at all leased, are also important. It so happens that had the government invited tanders, others may have had a chance to develop this very land under BOOT, but the BOOT project was "given away" at throw-away price to Adanies.

  6. AAP never said "sold". They said "alloted" and "transferred". You assumed "sold", that's your assumption and AAP is not liable to what you asume. AAP didn't hide anything. AAP doesn't become lier, if you asume/understand wrong. It's you misinterpreting, not AAP lying.

    Then, you are yet to prove the 14306 acres land was the same that was "leased", not other.

    In the next para, you have capitalized "ON SALE", but where is the proof? There is no such word there in your quote or AAP expose. Again, you havn't clarified the lease rates and period. This is important. For example, leasing for 99 years is as good as sale, and laws for such lease justify very high and incremental lease rates (which is not the case with Adanies, where by lease amount, even if it is indeed a lease is Re. 1 to 32 per square meter).

    Your third para needs the same Leased or Sold clarifications. You asume, where as you have to prove. For example, tell me if Mr. Modi leases the land at such rates for 99 years, is it not a loss to govt. exchequer? This is collusion and corruption.

  8. politically incorrect or completely incorrect .............................................. lets leave political party AAP and Go to the allegations of CAG....then this website will say the same that Vinod Rai is an agent of AAP and supreme court is also the agent of AAP ......... Please clarify the politically incorrect is in favor of which party. When it comes to AAP everyone has the right to speak, everyday thousands of people from different background give his advise and discuss. I would have appreciated if the website had favored some political leader or wrote against speech or allegations of some leader specifically but the website wrote in such a way which shows its not politically incorrect. Firstly media has boycotted AAp for last many months so What about it. What he has said doesn't matter if any media has not shown it and also AAP has gained popularity due to its few policy of management, giving ticket on winnable criteria etc.

    AAP is not taking this things as an advertisement tools. I am an Indian not from Delhi anyhow I had similar issue I got an electricity bill of 12000. definitely it was of 15 months. The reason was I had just applied for second connection. None came to give connection but I got the bill. I went to the office they asked to come latter. I ignored and bill went to 12000. I went again ,they did not responded and asked us to pay saying we don't have staff to see every house we just send an average bill of 200 unit per month. we had connections so the issue was closed but what about those who don't have connections.

    your article above has some basic mistake as you have not raised an issue its good but with that issue you are saying something else. AAP is dangerous to national security . etc.
    if AAP is giving ticket to some respected person than it is a big issue good and bjp or congress is giving ticket to criminals its good wow......

    1. Whatever Congress stance has been on non-corruption related issues, AAP's stance has been exactly the same. So in your reference above, along with Congress add AAP.

      Kejriwal's recent letter to a community in which he questioned Batla House encounter is proof enough to show the bleeding heart AAP has for terrorists. Then AAP's creation of a *special* committee only for "Muslim Issues" [http://delhi.aamaadmiparty.org/page/society-and-communities - Item# C6a] is another example of how AAP plays 'secular' Muslim card.

      If AAP wasn't pandering to Islamists & Muslims, why would it need to create a team *only* for Muslim issues? Are Muslims the only ones having issues in the country? Why's there no team for other communities' issues? Why no "Sikh Issues", "Hindu Issues", "Buddhist Issues" committees?

      If you're voting AAP in spite of their support for terrorists (Batla) and Minority appeasement (Special Muslim Committee), only God (if he indeed exists) save India. Every vote for AAP is a vote for Congress.

    2. I am an extreme supporter of Narendra damodar modi but not of BJP. Narendra Modi will be the prime ministerial candidate and not arvind kejriwal. Arvind kejriwal is contesting election for chief minister of delhi. Both arvind and narendra never fear death. they are ready to die, such a courageous persons should be appreciated. Arvind has participative style of leadership where common men can question the government and suggest his ideas. Modi is not participative and his leadership will remain till he will be alive but arvind will really bring a change and his leadership will be there after his death too.

      He has played muslim card. that's true. shikh, buddhists don't have issues or have issues similar to hindus, issue of hindu is a safe and curruption free india and he is raising all the hindu issues, he has wrote letter to bussinessmen, autowala and muslims etc... muslims are different and rest are same today there is almost no difference between christian or hindu but still muslims are different and one has to play muslim card but he is not using the language of mulayam, mamta or digvijay singh and nowadays nitish kumar....

      jharkhand was also ruled by BJP for long but we don't have 24*7 electricity or any appreciable work by BJP. They cheated us.

      If congress ruled india for so long BJP is also responsible for it and the allegation is completely true by AAP. AAP is showing a true path to BJP and if AAP wins in Delhi you will see many party like aap emerging and even BJP will change.Once AAP will win you will see case studies on the management techniques used by AAP to come to power. For winnablity other parties uses criminals and AAP needs 100 supporters which can promote him by visiting everyone house . I am just looking for a better india and will be possible when the rules will change for the MP and laws will be made strict for MP and MLA's and this can be done by arvind kejriwal and Not much by BJP.

      To conclude I am supporting him for he is doing what i can't,his party member are attacked and in hospital and he can be any day killed but still he is not afraid of anything. he don't have security. We have read about many freedom fighter but we never know that if we were alive at that time we would have criticized them or appreciated.

  10. All the point is when you compare the market price ie the sale price with the allotted price, you are saying that the land was sold. It is understood. In fact ask anybody who has only read the poll khol page, he will to you that mode sold the land at in 10 per unit. The point also is that Aap should have told general public that this land with infrastructure would come back to got.

What about poor farmers whose land has been snatched by Modi for this model of development,..farmers get nothing and it's justified by modi group .farmers have to fight a lost battle in courts for long 2. Modi has done all this without environmental clearance..so huge pollution is no concern for Modi ..he is to get it cleared now somehow and this is corruption but is justified by modi group...3.agreement period is for 30 years ...how clever the game will be over by then !! Is there an agreement sighned by Modi for how long he plans to fool the Nation ? Please share..

  15. I agree that there is exaggeration in what AAP is claiming, but its not completely untrue. More importantly, these questions are not being raised by media and need attention. There is some background research that they have done to support their claims, however hyperbolic they make it sound. I agree to your facts without verification for now, but this is one of the less serious claims that you have countered. Nothing is perfect, try be objective in your analysis and look at both sides without bias. Have a look at this article for e.g.
